National Mechanisms / Organisations working with Posted Workers - Slovakia

Mechanisms dealing with workers posted in Slovakia is based upon Statute No. 351/2015 Cross-border cooperation Act at posting workers in performance of labour at provision of services. This, was enacted with intention of transposition of Directive 2014/67/EU of the European Parliament and of the Council of 15 May 2014 on the enforcement of Directive 96/71/EC concerning the posting of workers in the framework of the provision of services and amending Regulation (EU) No 1024/2012 on administrative cooperation through the Internal Market Information System (‘the IMI Regulation’). Above mentioned acts stipulate the information duties of employers with regard to national authorities in the case of workers posted in Slovakia. It also deals with competence of National Labour Inspection Office in the process of cross-border cooperation with authorities of other EU-member states and with an issue of collaboration in the process of enforcing sanctions and fines imposed in the case of breach of law.

Other national legislation is Statute No. 311/2001 Labour Code as amended, which in its relevant provisions contains minimal rights of posted workers base upon Directive 69/71/EC (common minimal corpus of rights of posted workers). Other statutes like for example, Statute No. 124/2006 Health and Safety at Work Act, Statute No. 125/2006 Labour Inspection Act as amended etc. are applicable for all workers in Slovakia and do not deal specifically with posted workers only.

Purpose

The purpose of the Watchdog project and the online platform is to establish active mechanisms for control and monitoring of the posted workers’ rights across the EU via cooperation, exchange of knowledge and evidence-based approach of social partners, national labour inspections and European agencies.
