1. Posted workers Law 63(I)/2017 – transposing to national legislation the EU Posted workers Directive of 1996 and the Enforcement Directive of 2014
2. As in Cyprus there is no mechanism for declaring collective agreements universally applicable, only following legislations setting minimum terms and conditions of employment are applicable to posted workers:
a. Minimum wage order of 2012 applicable only to shop assistants, clerks, child-care workers (baby and children minders), personal care workers, security guards and cleaners
b. Compensation of overtime is only determined by law for shop employees (Law on the regulation of the operation of shops and the terms of employment of their employees of 2006-2016), hotel (Hotel employees (terms of employment) regulations of 1972-2016) and catering employees (Catering employees (terms of employment) regulations of 1968);
c. Working time legislation setting maximum weekly and daily working time, minimum rest time etc. (Organisation of working time Law 63(I)/2002 and Hours of work for employees’ order of 1990 applying only to white collar employees)
d. Annual leave legislation setting minimum duration of annual leave with pay (Annual Leave Law 8/1967)
e. Health and Safety at Work Law 89(I)/1996 (and various other health and safety legislative measures dealing with particular chemical substances)
f. Maternity protection Law 100(I)1997
g. Protection of young people at work Law 15(I)2012
h. Equal treatment of men and women in employment, vocational training, promotion and working conditions Law 205(I)2002
3. Undertakings subject to the legislation on the posting of workers are obliged to submit the following information to the Ministry of Labour and Social Insurance, before the posting: Name, address and legal entity of the undertaking, the legal representative of the undertaking and representative in Cyprus (if such a representative exists), place of work of posted workers, date of commencement of the provision of services, duration of posting, nature of activity and personal details of posted workers. In the event of changes, undertakings have to submit revised information within 15 days.
4. Apart from the Labour Department, the Social Insurance Services (SIS) are involved. The SIS is the issuing authority of the A1 PD (portable document that posted workers need to carry with them throughout the whole posting period).
